IN NO EVENT SHALL THE FOUNDATION'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT OF $100.00 OR THE AMOUNT OF YOUR DONATION (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS LESS.

Indemnification

You agree to defend, indemnify, and hold harmless Weber Human Services Foundation and its officers, directors, employees, volunteers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

Privacy and Data Collection

You consent to the personal jurisdiction of such courts.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any term or condition must be in writing and signed by an authorized representative of the Foundation.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Weber Human Services Foundation regarding your use of the Site and supersede any prior agreements or understandings.
